1. Acceptance of Terms

By downloading, installing, or using Winkply ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

Winkply is an AI-powered dating confidence platform that provides:

  • Voice roleplay practice sessions with AI conversation partners
  • Video analysis for body language and presentation coaching
  • Text message crafting and opener generation
  • Dating profile analysis and optimization suggestions

Our AI provides coaching suggestions only. We do not guarantee dating outcomes or matches.

3. User Accounts

To use Winkply, you must:

  • Be at least 18 years of age
  • Provide accurate and complete account information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account access

You are responsible for all activity under your account.

4. Acceptable Use

You agree not to:

  • Use the service for harassment, stalking, or any illegal activity
  • Generate content that is hateful, discriminatory, or sexually explicit
  • Attempt to reverse-engineer, decompile, or hack the App
  • Use automated tools to scrape data or overload our systems
  • Share generated content in a way that misrepresents AI output as human advice
  • Impersonate another person using AI-generated content

Violation of these terms may result in immediate account termination.

5. Intellectual Property

All content, features, and technology within Winkply are owned by Winkply AI. You retain ownership of any personal content you upload (photos, text). By using our service, you grant us a limited license to process your content for the purpose of providing coaching services.

6. Subscription & Billing

  • Free Tier: Limited sessions per month with basic features.
  • Pro Plan: Unlimited sessions, advanced AI features, priority processing.
  • Billing: Subscriptions are billed monthly or annually through your app store.
  • Cancellation: You may cancel anytime. Access continues until the end of your billing period.
  • Smart Auto-Pause: We automatically pause your subscription after 14 days of inactivity (if enabled). No hidden charges.
  • Refunds: Refund requests are handled through the respective app store (Apple App Store or Google Play).

7. AI-Generated Content Disclaimer

Winkply uses artificial intelligence to generate coaching suggestions, conversation starters, and analysis. This content is:

  • Generated by AI and may not always be appropriate for every situation
  • Intended as practice and suggestion only, not professional advice
  • Not a substitute for professional relationship counseling

You are solely responsible for how you use AI-generated suggestions in real conversations.

8. Limitation of Liability

Winkply AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to:

  • Dating outcomes or relationship results
  • Misuse of AI-generated content
  • Service interruptions or data loss

Our total liability shall not exceed the amount you paid for the service in the preceding 12 months.

9. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time through the app settings. Upon termination, your data will be handled as described in our Privacy Policy.

10. Governing Law

These terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
